“… Uniform Residential Landlord and Tenant Act… prohibit landlords from charging fees… to require disclosures; to provide for enforcement under the Consumer Protection Act; to provide civil penalties…” LB17 caps late fees at $50.00 LB17 requires us to process applications one at a time and in order received. LB17 caps the cost of your application fee at the cost you were charged to perform a credit/background check. LB17 does all this and more… with enforcement under the Consumer Protection Act and civil penalties. Make sure your voice is heard at the NE Legislature today and OPPOSE LB17!

"Senators, I am opposed to LB17 which caps late fees at $50.00. I believe this may lead a tenant to NOT pay rent on time as a late fee maximum of $50 is relatively small and insignificant – definitely less expensive than a payday loan. As property owners we did not get into the business to collect late fees and become default payday loan sharks, we want our tenants to be motivated and incentivized to pay rent on time and in full! LB17 requires us to process applications one at a time and in the order received, which complicates matters if you allow potential tenants to apply multiple ways for your properties. Multiple application methods is ultimately more convenient for our prospective tenants – some only use the Internet exclusively while others are unable/unwilling to use the Internet. LB17 caps the cost of an application fee at the cost of a background and credit check; so if your property management software includes credit and background checks with your yearly cost, how do I prove the cost of a single application fee charged if I was taken to court? How am I compensated for the time and effort to comply with all the current and these additional new regulations? As small business/property owners we will be forced to increase rents on ALL properties to make up the difference."
