Adopt the Landlord and Tenant Radon Awareness Act

 

LB506 concerns Radon mitigation. We all want to provide safe housing, but LB506 releases the tenant from your lease and you have to return 100% of the security and damage deposit without exception! An excerpt from lines 19 and 20 reads “If within the first ninety days of the lease agreement, terminate the lease without penalty or loss of security deposit.”

"I oppose LB 506. Senator Hunt wants to force landlords to scare tenants into getting radon testing of rentals by supplying tenants with her form that is factually incorrect, biased and otherwise controversial; other experts and researchers in the radon field have presented evidence contrary to Senator Hunts assumptions. Additionally, radon test results can change depending on the time of year, weather/soil moisture, and conditions within the home; the radon installation industry knows all the factors involved and could manipulate tests in order to sell more mitigation systems. Senators are you aware that 86% of radon related deaths occur in current and former smokers? The synergism between radon and smoking is a critical aspect of the relationship between radon and lung cancer. Overbearing government regulations contribute to the cost of rents in our market and housing costs in general. Government regulations constitute a significant portion of housing costs in Nebraska. Do not make the overbearing cost of regulation worse, please reject LB 506. Thank you."
